§ 1 Scope of application
The following General Terms and Conditions apply to the business relationship between the company Cottage Spirit, Am Weiherhof 20, 4701 Kettenis, Belgium (hereinafter: Seller) and the Buyer.
§ 2 Order
You can browse our website and the range of products from the comfort of your own home or while travelling.
If you have discovered a product that you are interested in, please contact us via our contact form, stating the product (product number) and the desired motif (motif number), as well as the desired quantity and your contact details. We will get back to you as soon as possible with further information and the order process.
Your data will of course be treated discreetly and will not be passed on to third parties.
§ 3 Conclusion of contract
When you place an order, you enter into a contract with Cottage Spirit, Am Weiherhof 20, 4701 Kettenis, Belgium.
You will be informed immediately of the receipt of your order by means of an e-mail called “order confirmation”.
The order confirmation is your written acceptance of the order and does not constitute acceptance of the contract. The contract for the purchase of a product is concluded when we confirm the acceptance of your order and thus the conclusion of the contract in a further e-mail designated as “order confirmation”. You will receive this message immediately, but no later than 3 days after we have received your order. The text of the contract, including your order, will be saved by us and will be sent to you on request together with our General Terms and Conditions. The language available for the conclusion of the contract is German.
§ 4 Reservation of unavailability
We reserve the right to refrain from fulfilling your order if we do not have the ordered title in stock. In this case we will inform you immediately about the unavailability and inform you about a new delivery date or, if applicable, immediately refund the purchase price already paid by you.
§ 5 Shipping costs
There are no shipping costs if you pick up the goods.
We can also deliver the goods on request. We charge the following rate for shipping:
– For our boards and larger items:
Belgium: 5,00 Euro / Each additional item 3,00 Euro.
(Delivery time approx. 2-3 working days)
Europe: 10,00 Euro / Each additional article 5,00 Euro
(delivery time approx. 3-14 working days)
– For our smaller articles like key rings, bottle openers etc.:
Belgium: 3,00 Euro / Each further item additionally 1,00 Euro
(delivery time approx. 2-3 working days)
Europe: 5,00 Euro / Each further article additionally 1,00 Euro
(Delivery time approx. 3-14 working days)
For larger orders, extra costs will be added due to the weight.
§ 6 Payment
6.1 On collection:
The purchase price is due upon collection of the goods in cash or by credit card.
6.2 In case of shipment:
If the goods are dispatched, the purchase price is due and payable without deduction within 8 days of invoicing to the account specified in the invoice.
At present we only deliver the goods on prepayment.
As soon as the money has been credited to our account, we will send the goods to you. We will send you a separate e-mail with the necessary information.
§ 7 Retention of title
The delivered goods remain the property of the seller until the purchase price has been paid in full by the purchaser.
§ 8 Warranty
The statutory liability for defects shall apply.
§ 9 Applicable law and place of jurisdiction
The law of Belgium shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant or a legal entity under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship shall be the court responsible for our registered office in Kettenis.
